Regulatory texts related to reportable diseases

The provisions governing the transmission of data on so-called “notifiable” diseases are codified in the Public Health Code, with the exception of executive orders.

The legislative provisions, which establish the principle of mandatory reporting, as well as the regulatory provisions, which describe the reporting process, are subject to prior review by the CNIL. This authority ensures that the rules regarding the protection of personal data (legitimate purpose, data minimization, retention limits, information and individual rights; security and confidentiality) are respected.

Legislative Provision

Article L. 3113-1 of the Public Health Code (law adopted following the opinion of the CNIL). This article establishes the principle of mandatory transmission by medical biology laboratories and physicians for two purposes:

  • the implementation of urgent local, national, or international interventions;

  • the implementation of specific surveillance measures to protect public health.

Procedure for reporting data on so-called “notifiable” diseases (decree issued by the Council of State following the opinion of the CNIL): Articles R3113-1 to R3113-7 of the Public Health Code.

List of diseases subject to mandatory reporting (simple decree):

  • to the Regional Health Agency (ARS) for the conduct of investigations with the support of partners: Article D3113-8 of the Public Health Code;

  • to Santé publique France for epidemiological surveillance purposes: Article D3113-9 of the Public Health Code.
